Terms of Service

These Terms of Service (“Terms”) govern your access to and use of lilyfloralcollective.com (the “Site”) and the products and services offered by Lily Floral Collective (“Lily Floral Collective,” “we,” “us,” or “our”), including floral arrangements, plants and gift items, flower subscriptions, local delivery and pickup, wedding and event floral services, and our email and text-message programs (collectively, the “Services”).

By accessing or using the Site, placing an order, creating an account, or using any of the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.

1. Eligibility and Customer Information

You must be at least 18 years old or the age of majority where you live to place an order or enter into a contract with us. If you use the Services on behalf of another person or organization, you represent that you have authority to bind them to these Terms.

You agree to provide current, complete, and accurate order, billing, delivery, and contact information. You are responsible for errors or delays caused by inaccurate or incomplete information.

2. Floral Products, Natural Variation, and Substitutions

Our floral products are handmade from natural, seasonal, and perishable materials. Product photographs show the general style, size, and color direction of an arrangement, but each design is unique. Exact flowers, foliage, colors, containers, shape, and appearance may vary.

When a flower, color, container, or other item is unavailable or does not meet our quality standards, we may make substitutions of equal or greater value while preserving the arrangement’s overall style, size, value, and intended color palette as closely as reasonably possible. By purchasing a Designer’s Choice or similar product, you give our designers creative discretion within the selections and instructions available for that product.

Products and fulfillment dates are subject to availability. We may limit quantities, discontinue products, or decline or cancel an order for legitimate business reasons, including product unavailability, suspected fraud, pricing or listing errors, or inability to complete delivery. If we cancel a paid order, we will refund the amount charged for the canceled item or order.

3. Orders, Pricing, and Payment

All prices are stated in U.S. dollars. Applicable taxes, local-delivery charges, and other fees are added at checkout or stated in a written quote unless expressly included in the displayed price.

Submitting an order is an offer to purchase. We accept an order when we send an acceptance or fulfillment confirmation or begin preparing the order, whichever occurs first. An automated order-received message does not necessarily mean that we have accepted the order.

We may correct typographical, pricing, or product-information errors before accepting an order. If a correction affects an order you submitted, we will give you the option to approve the correction or cancel the affected order for a refund.

Payments are processed through Shopify and third-party payment providers. Their handling of payment information is governed by their own terms and privacy practices. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the total shown at checkout or approved in your Event Agreement.

Discount codes and promotions are subject to their stated terms, may not be combined unless expressly permitted, and have no cash value.

4. Flower Subscriptions

The product page and checkout for each flower subscription state its price, delivery or pickup cadence, term, applicable local-delivery fee, and whether it renews automatically.

Unless the product page or checkout expressly states that a subscription automatically renews, a fixed-term subscription ends after the stated term and does not renew automatically. If an automatically renewing option is offered, you authorize us to charge the disclosed amount at the disclosed interval until you cancel. Cancellation applies to future charges and does not reverse a charge already incurred or an order already in preparation.

Subscription deliveries and pickups are scheduled according to the applicable product description. Holiday, weather, supply, or calendar conditions may require a reasonable schedule adjustment. If we make a material change, we will notify the purchaser using the contact information provided.

To request a subscription change or cancellation, contact us at hello@lilyfloralcollective.com or (816) 258-9955. Requests must be received at least 48 hours before the next arrangement is scheduled for preparation, delivery, or pickup. Fixed-term subscription payments are non-refundable after fulfillment begins except for unfulfilled arrangements we cancel or where otherwise required by law.

5. Weddings, Events, and Custom Work

Wedding, event, installation, and other custom floral work is quoted separately and may be governed by a proposal, estimate, contract, invoice, and/or deposit agreement (collectively, an “Event Agreement”). The Event Agreement sets the applicable scope, design process, payment schedule, deposits, rentals, change deadlines, cancellation rights, and other engagement-specific terms.

If an Event Agreement conflicts with these Terms, the Event Agreement controls for that engagement. An inquiry, consultation, mood board, preliminary concept, or estimate does not reserve a date unless the applicable Event Agreement expressly says otherwise.

6. Local Delivery and Pickup

Local delivery

We do not ship fresh floral products. Local delivery is available only within the service area and on the dates shown on the applicable product page or at checkout. Availability, delivery charges, and delivery windows may vary by product and date. Requested delivery times are not guaranteed unless we expressly confirm them in writing.

You are responsible for providing a complete and accurate recipient name, delivery address, telephone number, and any access instructions, including apartment, suite, gate, call-box, security, parking, or building information.

If the recipient is unavailable, we may, when reasonably safe and permitted:

  • leave the order with a receptionist, concierge, neighbor, or other authorized person;
  • leave the order in a reasonably safe location at the delivery address;
  • contact the purchaser or recipient for instructions; or
  • return the order to our studio and arrange pickup or redelivery.

Additional delivery charges may apply to a requested redelivery or to a failed delivery caused by incorrect information, unavailable access, or the absence of a safe delivery location. A delivery record, timestamp, photograph, or carrier confirmation may be used as evidence that delivery was completed.

Once an order has been delivered to the address provided or released to an authorized recipient, we are not responsible for theft, loss, neglect, heat, cold, weather exposure, or improper care occurring afterward, except to the extent caused by our failure to exercise reasonable care or as otherwise required by law.

Pickup

Pickup is available at 922 E 5th St, Kansas City, Missouri 64106 during the pickup date and time shown in your order confirmation or otherwise arranged with us. Current studio hours may be found on the Site and are subject to change, holidays, and appointment availability.

Orders should be picked up at the confirmed time. Because flowers are perishable, we are not responsible for deterioration caused by late pickup. Please contact us promptly if you need to request a different pickup time.

Delays outside our control

Severe weather, unsafe travel conditions, road closures, venue restrictions, product shortages, utility failures, government action, and other events outside our reasonable control may delay, modify, or prevent fulfillment. We will make reasonable efforts to communicate material delays and offer an appropriate reschedule, substitution, store credit, or refund for any portion we cannot fulfill.

7. Cancellations, Returns, Refunds, and Quality Concerns

Standard orders

To request a change or cancellation, contact us at least 48 hours before the scheduled delivery or pickup. If we approve a timely cancellation before preparation or procurement begins, we will refund the canceled amount to the original payment method.

Orders placed within 48 hours of delivery or pickup, and orders for which preparation or special procurement has begun, may not be changed or canceled. We may nevertheless offer a change, credit, or partial refund in our discretion.

Quality concerns

If an arrangement is damaged when delivered, materially differs from the order, or has another quality issue attributable to us, contact us within 24 hours after delivery or pickup. Include the order number, a description of the issue, and clear photographs of the full arrangement and affected area. Because flowers are perishable, prompt notice helps us evaluate and resolve the issue.

When a timely claim is verified, we may provide a replacement, repair, store credit, partial refund, or full refund, depending on the circumstances and product availability. This does not limit any remedy that cannot be limited under applicable law.

Returns and refunds

Fresh flowers, plants, food items, and other perishable goods generally cannot be returned. Gift and nonperishable-item returns, if available, are governed by the return terms displayed for the item or our posted Refund Policy.

Approved refunds are issued to the original payment method. Bank and payment-provider processing times are outside our control. Delivery charges already incurred and completed custom services are not refundable unless the underlying service was not provided as agreed or applicable law requires otherwise.

Custom, wedding, and event cancellations are governed by the applicable Event Agreement.

8. Product Care, Allergies, and Safety

Flowers and plants may contain pollen, sap, thorns, wires, picks, preservatives, small decorative components, or species that may be harmful if ingested by people or animals. Keep floral products, plant materials, packaging, and flower food away from children and pets. Do not consume any product unless it is expressly sold and labeled as edible.

You are responsible for reviewing care instructions and determining whether an arrangement or plant is appropriate for the intended location, recipient, household, or pets. Contact us before ordering if you have a known allergy or safety concern. We cannot guarantee an allergen-free arrangement or environment.

9. Gift Messages and Recipient Communications

If you provide a gift message or ask us to contact a recipient, you represent that the content and contact information are lawful and appropriate. We may decline to transmit content that is threatening, discriminatory, deceptive, obscene, infringing, or otherwise unlawful or harmful.

We may contact the purchaser or recipient as reasonably necessary to coordinate or confirm an order, delivery, pickup, substitution, or service request. These operational communications are not marketing messages.

10. Email Marketing

When you affirmatively subscribe to marketing emails, or when otherwise permitted by applicable law, you agree to receive promotional emails from us. Email frequency varies.

You may unsubscribe at any time using the unsubscribe link in a marketing email or by contacting hello@lilyfloralcollective.com. We will honor valid opt-out requests within the time required by law. Opting out of marketing does not prevent transactional or service-related emails, such as receipts, order confirmations, delivery notices, subscription notices, or responses to your requests.

Our marketing emails will identify the sender, use non-deceptive subject lines and routing information, provide a valid postal address, and include a clear method for opting out as required by applicable law.

11. SMS/Text Message Program

If you affirmatively opt in to our text-message program (the “SMS Program”), you provide your prior express written consent to receive recurring automated promotional and marketing text messages from or on behalf of Lily Floral Collective at the mobile number you provided. Messages may include promotions, seasonal offers, product announcements, and cart reminders.

Consent to marketing texts is not a condition of purchase. Message frequency varies. Message and data rates may apply.

You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to receive messages at that number. If you change, transfer, or deactivate the number, you agree to notify us promptly.

You may withdraw consent at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE to a message. We will also honor any other reply or reasonable request that clearly communicates that you want the texts to stop. You may receive one non-promotional confirmation text after opting out. We will process opt-out requests within a reasonable time and no later than required by applicable law. To rejoin, complete a new opt-in.

Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.

Mobile information will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. We may share information with vendors and telecommunications providers solely as needed to operate and support the SMS Program, prevent fraud, maintain consent and opt-out records, and comply with law. Text-message opt-in data and consent will not be shared with third parties for unrelated marketing.

We may change or end the SMS Program or change the sending number. If required, we will notify participants of a material change. Your use of the SMS Program is also subject to our Privacy Policy.

12. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate an account that violates these Terms or presents a security, fraud, or legal risk.

13. Intellectual Property

The Site and its content, including our name, logos, branding, copy, graphics, photographs, videos, floral-design images, and page layouts, are owned by or licensed to Lily Floral Collective and are protected by intellectual-property laws. Except as allowed by law, you may not reproduce, modify, distribute, sell, license, scrape, or commercially exploit that content without our prior written permission.

If you voluntarily submit a review, testimonial, photograph, or other content directly to us for publication, you grant us a non-exclusive, worldwide, royalty-free license to reproduce, display, adapt for formatting, and use that content to operate and promote our business. You represent that you own or have permission to submit the content and that our permitted use will not violate another person’s rights. You may withdraw permission for future uses by contacting us, although withdrawal does not require us to recall materials already printed or distributed.

Tagging or mentioning us on social media does not, by itself, grant us permission to use your content outside the features ordinarily provided by that platform. We will seek permission before reposting it in our own marketing.

14. Acceptable Use

You may not use the Site or Services to:

  • violate any law or another person’s rights;
  • submit false, fraudulent, abusive, discriminatory, or harmful information or content;
  • interfere with the Site’s operation, security, or access controls;
  • introduce malware or other harmful code;
  • scrape, harvest, or collect data without authorization;
  • impersonate another person or misrepresent your affiliation; or
  • use the Services in a way that could damage Lily Floral Collective or others.

We may restrict access or cancel an affected order when reasonably necessary to address misuse, fraud, safety, security, or legal concerns.

15. Third-Party Services and Links

The Site uses Shopify and may rely on third parties for payment processing, hosting, analytics, communications, delivery coordination, and other functions. Third-party websites, applications, and services are governed by their own terms and privacy practices. We are not responsible for third-party content or practices, but nothing in this section limits our responsibility for vendors acting on our behalf where applicable law makes us responsible.

16. Disclaimers

To the fullest extent permitted by law, the Site and Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will always be available, secure, or error-free.

Natural variation, reasonable substitution, and the ordinary lifespan and perishable nature of floral products are not defects. Any description of expected vase life is an estimate and depends on product type, environment, handling, and care.

Some jurisdictions do not allow certain warranty exclusions. Any warranties or consumer rights that cannot legally be excluded remain in effect.

17. Limitation of Liability

To the fullest extent permitted by law, Lily Floral Collective and its owners, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or data, arising out of or relating to the Site or Services.

To the fullest extent permitted by law, our total liability for a claim arising out of or relating to a product or service will not exceed the amount you paid us for the specific product or service giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including where applicable liability for gross negligence, willful misconduct, fraud, or personal injury caused by a party’s negligence.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Lily Floral Collective and its owners, employees, contractors, and agents from third-party claims, damages, losses, liabilities, and reasonable legal expenses arising from your unlawful misuse of the Services, your violation of these Terms, or content you submit that infringes another person’s rights.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any lawsuit arising out of or relating to these Terms or the Services must be brought in a state or federal court with jurisdiction in Jackson County, Missouri, and each party consents to the personal jurisdiction and venue of those courts.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or limits a consumer protection available under law that cannot be waived by contract.

20. Changes to the Services or These Terms

We may modify the Site, the Services, or these Terms from time to time. The “Last Updated” date identifies the current version. Material changes will be posted on this page and, when required or appropriate, communicated through the Site or the contact information associated with your order or account.

Changes apply prospectively when posted or on the later date stated in the notice. They do not retroactively change the material terms of an accepted order or signed Event Agreement. Your continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms.

21. General Terms

These Terms, together with the Privacy Policy, applicable product and promotion terms, and any Event Agreement, form the entire agreement between you and us concerning the applicable Services.

If any provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the business.

Section headings are for convenience only. Provisions that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, liability limitations, indemnification, and dispute provisions—will survive.
